A DRINK-driver was found to be over the legal limit after a police officer pulled him over for using his mobile phone.
Joseph Brice, 25, told Colchester Magistrates’ Court he had drunk alcohol the night before but thought he would be safe to drive on the morning of his arrest.
He was pulled over by an officer in Straight Road, Colchester, at around 9.45am on November 5.
Following a breathalyser test, he was found to have 45 mcgs of alcohol in 100 mls of breath. The legal limit is 35.
Brice, of Coldnailhurst Avenue, Braintree, admitted drink driving and using a mobile phone while driving.
Brice was banned from the roads for a year and ordered to pay £355 in costs.
