A NUISANCE beggar will learn next week if he is to be banned from Colchester’s Greenstead estate.

Bevan Ash, 42, lives with his mum in Greenstead, but Colchester Borough Homes wants an injunction preventing him from entering the estate.

The case was due to be heard at Chelmsford County Court on Tuesday, but was adjourned until Tuesday next week, so Mr Ash’s legal team can prepare the case.

Recorder David Bedingfield made the decision after receiving a letter from Mr Ash’s solicitor, Paul Baker, saying he needed more time. Rebekah Straughan, representing Colchester Borough Homes, said the injunction would help to protect Mr Ash’s mum’s tenancy, which could be threatened by his behaviour.

In addition, Mr Ash’s mother is unwell and her registered carer, her daughter, will not attend the house if Mr Ash is there.

Colchester Borough Homes, which is responsible for Colchester Council’s social housing, won an unprecedented ten-year banning order against Mr Ash in December, but it was over-turned a month later on appeal after a judge ruled Mr Ash did not have time to defend himself against the order.

The court was told Mr Ash owes £3,000 in rent arrears, but is not registered as homeless.

Recorder Bedingfield said: “He has a right to go to that home as his mother is not asking him to leave.

“I am sympathetic to the dilemma.

“This is a fairly draconian step and is fairly rare.

“I am troubled by this application, so I will adjourn to give Mr Ash a chance to attend.”
