Maldon District Council has pleaded not guilty to failing to ensure the safety of swimmers at Marine Lake.
The council did not appear at Chelmsford Crown Court on Monday, instead denying the allegation by letter.
The prosecution comes after the Health and Safety Executive decided that the council had failed in its duty of care following the death of a man in Maldon's Marine Lake in August 2002.
The trial is set to start on August 31 and is expected to last for two weeks.
