Angry residents have vowed to continue the fight to save a former school field from development.
A committee of residents from east Clacton said the land, at the former Windsor School site in Holland Road, should be safeguarded for the use of the community.
Plans by Cosy Developments to build 24 homes at the site were refused by Tendring Council's planning committee for the fourth time in September.
Carl Symes, managing director of Cosy Developments, said: "The decision is now in the hands of the planning inspectors, and I await their decision."
Residents wishing to make representations for or against the development should write to the Planning Inspectorate before May 9.
