A MAN who failed to comply with a breathalyser test has been handed a suspended prison sentence.
Police officers ordered Steven Holmes, 44, to take the test after being stopped while driving in Colchester on July 17 of last year.
Holmes, of Mays Lane, Dedham, admitted the offence when he appeared at Colchester Magistrates’ Court.
Magistrates decided to spare him prison due to the effect it would have on his young child.
He was handed a 14 week sentence, suspended for one year, and banned from driving for three years.
Holmes must pay £774 in a surcharge and costs.
