A MAN assaulted his own mother in a car park brawl which led to fatal injuries to a 46-year-old man.

The jury at Ipswich Crown Court were shown video footage of Byron Warburton, who serves as a corporal in the British Army, stamping on his mother who was panicking while her husband, Steven Warburton, lay motionless on the ground of Vineyard Street car park in Colchester.

Byron Warburton’s father, Steven, had been knocked unconscious by defendant Brodie Groome in the early hours of August 19 last year.

He died three weeks later as a result of a cardiac arrest, which medical experts agreed was a result of his initial head injuries.

Groome, who was initially charged with causing grievous bodily harm with intent to Mr Warburton, now faces charges of manslaughter which he denies.

But Byron Warburton, who had brawled with the defendant after celebrating his first wedding anniversary with his wife and parents, was quizzed by the prosecuting barrister Nicola May about his own behaviour that evening.

His wife Olivia Warburton, who appeared in court as a witness, said: “He just went into a fit of rage and just took it out [on her].”

When asked about his behaviour, Byron Warburton said: “My mother was making things worse by lifting his [Steven Warburton] head up and dropping it, but it wasn’t intentional.

“I was extremely angry at the time. I took it out on my mother and shouldn’t have done.

“I remember blaming her, but it was just aggression.”

When asked by Miss Crawford whether it had been a physical assault, Mr Warburton replied: “Yes it was.”

Mr Warburton subsequently accepted a caution following the assault of his mother when he was taken to the police station that evening.

As for his own part in the fracas, Byron Warburton accepted that he had played a significant part in the brawl.

He said: “I was kicking one of the males - we were all fighting.”
