Mistley Quay court battle continues despite judge ruling Mistley Quay court battle continues despite judge ruling

THE SAGA around Mistley Quay is still not over despite a high court judge throwing out a case protecting it.

Trent Wharfage Logistics (TWL), which erected a six foot fence at Mistley Quay, is contesting Tendring Council’s Conservation Area Management Plan (CAMP) for Manningtree and Mistley.

It said the CAMP, which listed ambitions for a fence which was more in keeping with a conservation area, went against the port growth laid out in the legally enforceable local plan.

A judge said although the CAMP had included the desire for a better fence, it was not a legal document which could be enforced.

Even though he threw out the plea and also said future appeals would be refused, Trent Wharfage has applied to the Court of Appeal to contest the high court decision.
