Co-op’s £10k legal bill for Tesco fight

A LEGAL battle to halt a Tesco superstore being built has been quashed, leaving a rival store with a bill for £10,000.

Tesco was given permission to build in Station Road on the border of Manningree and Lawford last July.

But rival chain the Co-operative Society, which is based in Riverside Avenue East in the town, lodged an application for a judicial review with the High Court, stating the permission was “unlawful” and “irrational”.

Co-op bosses said legal action would be taken if a list of demands were not met including that the application go back before the planning committee.

But the council argued the accusations were unfounded and opted not to hold round-table talks with both parties.

A judge has now refused the judicial review application on all of the ten points put forward.

Carlo Guglielmi, Tendring’s planning boss, said: “I am so pleased with the decision. We have maintained all along that the application has gone through the democratic process.

”It is quite pitiful. The Co-op had three years to come up with objections, but waited until the last minute to do this, It was clutching at straws.

“We will be seeking costs. This is public money we are talking about.”

The judge ordered the Co-op to pay £10,000 costs for Tesco, and advised Tendring Council to apply to the High Court for its costs.

However, the Co-op has vowed the fight will go on.

Roger Grosvenor, group general manager for trading for the East of England Co-operative Society, said: “While we were disappointed by the initial decision our application seeking leave to appeal was declined, we have instructed our legal advisors to ask for a review of the situation and put forward a renewal application.

“We believe the decision made and the processes used by Tendring Council were flawed and will continue seeking to overturn the decision.”

Louise Gosling, Tesco’s regional corporate affairs manager, said: “We remain confident Tendring Council’s decision to support our plans for Manningtree was robust.

“We look forward to working with them to deliver the plans as soon as possible.”

Nothing new here - the Cooperative are very aggressive in protecting their interests; perhaps the money would be better spent on reducing their prices to make the retail grocery section of their business more competitive.

Spot on RH. I was in the Abbot's Road co-op this evening and they've still got Xmas stuff in there 1/3 off some items, stacked next to the Easter Eggs!

Whether its right or wrong, the Co-op stand no chance again the Japense Knotweed that is Tesco. RIP Manningtree and Lawford its been a pleasure.

SURELY...NOT A MEASLY 10 K ??...OVERPRICED GROCERIES IN THEIR STORES SHOULD COVER THAT ! With you Lawford Lass. Tescos will kill off Manningtree and Lawford with their non-local produce that contains more 'e's than a night club. I call into the Co-Op once a week and its a breath of fresh air to see the amount of local produce they stock. Why the council ever approved the plan is beyond belief. Before we know it the Co-Op and other shops in the area will close hitting not only the people that work there but the local producers as well.

The urge to monopolise trade is exemplified by Tesco, people may think they are getting more choice but that is the very opposite of the eventual outcome.

Thank you Boris, you're right it is rude to shout and if Something2Say thinks there will be choice they are clearly deluding themselves. Yes while the store is being built it will create tradesmens jobs but the all the other jobs created will be replaced by the jobs lost from The Co-op, Townsends, The Toy Shop, and how many jobs do they think will be full time? Tesco's are quoting an estimated 180 but is that part time or full time? And as for value for money don't make me laugh, buy a joint of meat from each store and then measure it again after its cooked..... Tesco's will be half the size once all the water has come out, as far as I'm concerned you get what you pay for. And no I don't live on the Dale and no I don't have a problem with the level crossing, sometimes its slow when the barriers are down but thats to be expected. I have more of an issue with numpty's driving horse boxes into it and cars stopping over the keep clear signs.

The people who will build the new Tesco will not be local people but outsiders that Tesco bring in.
At the planning inquiry Tesco was granted planning permission on a minority vote. Of 11 councillors only 5 voted for it. There were 4 extensions including the chair-person who spoke out about the Tesco is Stalham in Norfolk that was killing the town's trade there How can you possibly abstain after speak out against them. A TDC official said that the new store would employ 150 of which 120 would be full time . What a complete lie. Yet none of the councillors picked this up.I think they were missled at the inquiry as the evidence was not presented properly, and they did not have enough knowledge to ask the right questions.
Tesco had previously had planning permission turned down because of traffic congestion. So what changed to alter this.
