A HIGH Court challenge which aimed to block the controversial Tollgate Village has failed.

It means unless claimants Fenwick and Lion Walk Property, which owns Lion Walk shopping centre, choose to appeal the Honourable Mrs Justice Lang’s decision, the £70 million retail and leisure park, in Stanway, will now go ahead.

The scheme had been approved by the Sajid Javid, the Secretary of State for Communities and Local Government, in August but the town centre landowners launched a bid for a judicial review in September.

It is understood the application was launched on a number of dispuited legal matters used by the appeal inspector and the Secretary of State to reach their decision.

But yesterday, Mrs Justice Lang refused permission, stating: “In my judgment, the reasons given by the defendant [Secretary of State], supplemented by reference to relevant findings in the inspector’s report, were both adequate and intelligible, and the claimants have no prospect of success on this ground either.”

Daniel Watts and Jayne Gee, directors of Tollgate Partnership Limited, which is behind the Tollgate Village plans, said: “We welcome the judge’s decision.
