A MANAGER banned from running a care home after residents had to be removed for their own safety has had her appeal dismissed.

Brookfield Residential Home, in Hayes Road, Clacton was closed last year after inspectors found “even the most basic level of care was not being provided”.

Manager Lystra Dorval challenged the Care Quality Commission’s subsequent decision to cancel her registrations as manager and care provider.

However, she lost her appeal at a Care Standards Tribunal.

Husband Jon Dorval also lost his appeal against his registration being removed, according to a report published on November 11.

Judge John Burrow said major concerns were first identified in 2011.

By November 2014 the situation was even worse.

One patient, with severe ulcers, bruises and other injuries, had not been seen by a district nurse for three years and outlawed methods were being used in the care of residents.

Other issues included poor hygiene, handling of medicines, inadequate staffing levels and out of date care.

Judge Burrow said: “Professionals were concerned about the ability of Mrs Dorval to identify improvements, take action to assess them and sustain them.

“She did not acknowledge the concerns of the CQC and others and had not taken the opportunity to learn from concerns and take appropriate action.

“The home did not engage positively with people who raised concerns to find a way forward for resolution and there were no systems in place to monitor the safety and quality of the service provided.”
