A MAN raped a vulnerable 13-year-old, a court has heard.

Miley Byrne, 28, of Challis Lane, Braintree, has denied two counts of sexual activity with the girl and one count of raping her in summer 2012.

The girl, who cannot be named for legal reasons, claimed she was “infatuated” with Byrne and felt lonely.

She told Chelmsford Crown Court they had been drinking on her parents’ sofa when he started to kiss her and remove all her clothes before they had sex.

She said that when he tried to push her onto the sofa, she shook her head and tried to push his hand away.

She told the court, being presided over by Judge Patricia Lynch, she had told him that it was uncomfortable and that she didn’t like it.

She said she just froze whilst he was having sex with her.

The court heard the girl told her school friends she had slept with a boy, and the gossip quickly spread around school until teachers were alerted.

The girl was called into a meeting and afterwards told her sister, who later informed her mum.

The teenager then claimed she had made everything up and no further action was taken.

However, she was contacted by another girl who also claimed she had been raped by Byrne and later made the allegation of rape to the police, the court heard.

Laura Brickman, defending, suggested that she made the episode up for attention.

She said: “You thought that he was quite cool, quite nice, quite fit and you had a bit of a crush on him.

“You knew you parents did not like him, but you were in a rebellious mood.”
